Objectives

1. President= 1 ( Bachelor’s degree + 15 years experience, Nominated by GoN)

Ineligibility For Being A Member Of NEC

  • Non-Nepalese citizen.
  • Person whose name has been removed from book.
  • Person whose property has been divided proportionately among the creditors for being bankrupt.
  •  Person who has been punished by law.
  • Mentally disordered person.
  • Person who has received permanent resident (PR) certificate of any foreign country.

Disqualification for being a MEMBER

  • If above ineligibility criteria are valid.
  • If resignation is approved from the post of member.
  • If absent in council meetings for 3 times continuously without informing the council.
  • Death.

Meeting of the council

  • Meetings of council should be held minimum 4 times in a year.
  • Meetings can be held more than 4 times if called by the president.
  • Meetings are held in the place and time finalized by the president.
  • Meetings are presided by the president. If the president is absent, the vice-president presides over the meeting.
  •  Minimum 50% of the members should be present in a meeting to fulfil the quorum.
  •  Decisions are authenticated by the Member-secretary.

Registration of name in NEC

  • To register the name, an applicant should pass the exam conducted by the council.
  • Minimum of 2 exams will be conducted by the council every year
  •  A 5 member exam committee having at least one woman will be formed to conduct exams with the register as member secretary and the NEC member as coordinator.

Name of the engineer will be removed from the in following case:

  •  If he/she has qualities which make him/her ineligible to become a member of council ( mentioned earlier)
  •  If a motion submitted to a meeting of council to remove the name from the book on charge of violating professional code of conduct is passed by two third majority

(NOTE: To examine the violation of code of conduct by any member, a separate examination committee will be formed. The committee should prepare a report and submit the report to the meeting of the council)

  • If the name of a person Who does not possess the required qualification has happened to be registered by fraud or error.

Re-registration of the name :

  •  An engineer whose name has been removed from the registration can apply for the registration of the name in the council after 1 year with sufficient evidences of him/her being innocent.
  • Upon examination of the evidences, the council can reregister his/her name in the registration book.

Recognition of academic institution and certificates of academic qualification:

  •  Any institution should be granted recognition from the council before they start teaching any engineering subject.
  • The council can grant temporary or permanent recognition to the educational institutions for teaching engineering subject after evaluation of the academic institution.
  • The permanent recognition should be obtained by the institution after 5 years of getting temporary recognition ( NEC Regulation)
  • The criteria set out for evaluation by the council are based on legal capabilities, academic capabilities, physical capabilities, manpower, infrastructure etc.
  • To get the recognition from NEC, an institution should get minimum of 70 % score on evaluation criteria.
  • The council inspects the academic institution on a regular basis in order to ensure that the institutions have continuously maintained the criteria set forth by the council.
  • The inspection of institution having permanent permission is done once in every two years and those of temporary is done once in a year.
  • The council shall recognize the certificates of academic qualification in an engineering subject.

Punishment:

If any person practices engineering profession without getting name registered in council, he/she may be liable to a punishment with fine amount upto Rs. 10,000 or imprisonment of 3 months or both.

If any person does whatever against the provisions made in the Act and Regulation will be fined Rs. 25,000.

Dissolution of the Council:

  • If the council fails to abide to the clauses and rules mentioned in the Act and the Regulation, the Government of Nepal can dissolve the council.
  • After the dissolution of the council, the GoN performs the responsibilities of the council or cause to perform the responsibilities of the council by forming a committee.
  •  The GoN of Nepal should form a new council within 3 months from the time of dissolution of the council.

Submission of yearly Report:

  • The council should submit the report to the GoN regarding its works, administrative expenditure, income, expenditure, future programs within the month of Ashwin every year.

Miscellaneous:

  • The council should make contact with the GoN through Ministry of Physical Infrastructure and Transportation.
  • The council has right to make rules and regulations in accordance with clause no 37 .
  •  No of engineering disciplines recognized by NEC = 57
  • Total no. recognized universities = 810 (As of Nov. 2021)
  • No. of countries whose universities have been recognized = 45 (As of NOV. 2021)
  • No of code of conduct= 11
  • No. of universities in Nepal running engineering programs = officially 6 (As of Nov. 2021)

(Manmohan technical university is added as 7th,but it is not officially approved)

Some provisions of NEC Regulations 2057

Registration categories of engineer:

Category A:General Engineer:

  •  Minimum BE
  • Should pass the written examination conducted by the council for the registration
  •  Registration charge Rs. 5000 for students studied in Nepalese Universities. (Additional Rs 400 For Id Card)

Category B:Professional Engineer:

  • Minimum Master’s degree and should have minimum experience of 7 years as general engineer.
  • Should pass the written examination, skill test examination and an interview for the registration.
    (Registration charge Rs. 20,000)

Category C: Foreign Engineer:

  • Minimun BE degree and 10 years of experience
  • Should submit following documents along with the registration application fee of 1500.
  • Name and address of the organization/employer where the engineer is looking forward to work for
  • Cause, nature and description of the work along with the recommendation of the employer in Nepal
  • Valid Bachelor’s degree certificate
  • Copy Of the engineering license of their respective county (if required)
  • Experience letter (With minimum 10 years of experience)
  • Copy of the passport and visas.
    Registration Charge = Rs 30000
    Registered for 2 years
    (Renewed for 1 year at once for any no. of times on request of employer)
  • Renew charge =Rs. 30000 (Same as the registration charge)

CODE OF CONDUCT :

There are 11 code of conducts mentioned in NEC at chapter 4 Rule 18.

  • Discipline and honesty
  • Politeness and secrecy
  • Non-discrimination
  • Shall have to do only the concerned professional work
  • Not to do such works, which may cause harm to engineering profession
  • Personal responsibility
  • State name, designation and registration no.
  • NO publicity or advertisement shall be made which may cause unnecessary effect
  • Should not perform or cause to perform any work with wrong intentions
  • Should avoid or cause to avoid negligence during any work
  • Should not prepare or recommend ( or cause to prepare or recommend) wrong or malicious reports of any tests
